Terms of use

HailIndex.com · Last updated May 1, 2025

1. Acceptance

By accessing HailIndex.com, you agree to these terms. If you do not agree, do not use the site. These terms apply to all visitors, whether or not you submit any information.

2. Informational purpose only

All cost estimates, risk scores, storm data, and other content on HailIndex.com are provided for informational purposes only. They do not constitute:

  • A contractor quote or binding estimate
  • Insurance advice or claims guidance
  • Legal advice
  • A guarantee of repair or replacement cost

Always obtain actual quotes from licensed contractors and consult your insurance policy before making repair or replacement decisions.

3. No warranties

HailIndex is provided "as is" without any express or implied warranties. We do not warrant that cost estimates are accurate for your specific property, that storm data is complete, or that the site will be available without interruption. Data is derived from public sources that may contain errors or lags.

4. Limitation of liability

To the maximum extent permitted by law, HailIndex and James Merritt shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of this site or reliance on any content, including cost estimates, storm data, or contractor referrals. Your use of the site is at your own risk.

5. Contractor referrals

HailIndex connects homeowners with roofing contractors through a paid referral network. We do not employ, supervise, or vouch for the quality of work performed by any contractor. Contractors are independent businesses. Always verify licensing, insurance, and references independently before engaging a contractor.

6. Lead submissions

By submitting a lead form, you consent to HailIndex sharing your contact information with roofing contractors in the referral network. You represent that you are the property owner or authorized agent, that the contact information is accurate, and that you are 18 years of age or older.

7. Intellectual property

The HailIndex methodology, site design, written content, and cost calculation algorithms are the property of James Merritt. Underlying data is sourced from public government datasets (BLS, NOAA, Census Bureau) and remains in the public domain. You may not reproduce, scrape, or republish site content for commercial purposes without written permission.

8. Links to external sites

HailIndex links to government data sources and external resources for reference. We are not responsible for the content or availability of external sites.

9. Governing law

These terms are governed by the laws of the State of Colorado, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Colorado.

10. Changes

We may update these terms at any time. Continued use of the site after updates constitutes acceptance of the revised terms. The "Last updated" date above reflects the most recent revision.
